experience on labour market in malaysia, i would like give some opinion and
suggestion to improve overall management of foreign worker in our new malaysia.<o:p></o:p></div>

First we start from getting approval for foreign worker in
KDN. Let say a employer manage to obtain
a kdn approval for 50 workers for manufacturing which his factory need in
urgently. Next step he need register in FWCMS and submit for calling. In Kdn
approval stated that the manufacturer only can bring in workers from source
country which is Bangladesh, Myanmar, Thailand,Nepal,Indonesia, Philipine,
Pakistan, Uzbakistan, Turkanistan, Srilanka,Combodia, Laos, Vietnam. Out of
this country, Bangladesh, Mynmar, and Nepal can’t bring in for the moment because
of there is no proper mechanism in way . The major country source of workers
literally eliminated. India workers not a source country and Indonesian male
cant be employed in factories. Now the left is other not favorable countries
which Malaysia manufacturer need to do hard work to get reliable workers. This
kind situation left them in lurch and eventually encourage them hire illegal.
If let say the manufacturer found workers from particular source country and
applied calling visa through Fwcms and it would take another month for the
workers to arrive. Then if there is some workers do not come after calling visa
out , the replacement workers must be from same source of country which i feel
is not fair to employers side. For information before FWCMS implemented
employer can apply any other source country workers for replacement. The system
should be improved but it has been modified to satisfy the vendor not employer.<o:p></o:p></div>

Source country dilemma existing since 20 years back and we
don’t know what the basis of choosing source countries. Why Indonesian male and
India which has pool of workers can’t be source country for manufacturing? The
world keeps up changing but law in KDN hasn’t change for past 20 years. The
same kind of problems happening in other sector as well. For the moment
employer can’t bring in workers from Bangladesh, Myanmar and Nepal which make
3/5 of total registered workers. After paying levy about rm1850 (not including
coffee money) for each worker, employer has to struggle to find workers<o:p></o:p></div>

The real problem in our country is about illegals not the
registered 1.89m workers. All registered workers particulars even their thumb
prints all in system and can retrieve any point of time. Jtk and kdn always
come up new mechanism for this registered workers but not for hindering
illegals. I suggest JTKSM and Kdn focus on illegals which more damaging our
sovereignty. First pls improve myimm system which control in n out tourist and
immigration. For your information, since visa on arrival implemented, all blacklisted
gain entry to our country easily because the system doesn't work as promised
but become money generating machine for vendor. A simple checking can prove my
statement. The immigration system should be like in Singapore or China. Every
entry should be monitored to eliminate tourist visa misused cz illegal get
entry mostly through air . In china, they have amassing system can trace
whereabouts of a single tourist within minute. Spend money on system.<o:p></o:p></div>

it world known truth that Malaysia had a licensed human
trafficking system called SPPA . Luckily it was abolished since pakatan taken
over. Thought the system hundreds of workers brought in as legal and made them
illegals within 6 months of time because of brecurassy and bribery. Well
connected vendors collect not less than rm15k to 20k from each worker in
Bangladesh and send them to Malaysia
employers. Just go ask these workers how they repaying their loan in Bangladesh
with minimum wage they get from employers. Most of them look for better payment
employer within Malaysia for their survival and end up as illegals. Whom to
blame on this? Politician and vendors who raked million from this Bangladeshi
workers still roaming freely but normal Malaysian expected to pay new taxes in
coming budget. So a right system should be in place so that legal workers
should be protected not abused. Online renewal and mandatory insurance are
welcomed.<o:p></o:p></div>

1) Give 3 months’ probation period for new
worker who arriving in calling visa. Within these three month of time worker
can decide whether they want stick to employer or return to country. By given
this option, workers would not work if employer didn’t follow what he promised
while reqruitment. Employer too can choose worker which suit to his work
condition and employ permanently. Three months initial salary can be used to
send back the worker if not suited. Allow replacement calling visa immediate.
The 3 months’ probation period can be given when the worker enter to country.
Currently they are giving 1 month. So no extra workload to immigration<o:p></o:p></div>

2) Service
sectors approval mainly for restaurant should emulate Sabah immigration
method. Number of foreign worker should
be given based on restaurant size and operational hours. If the restaurant is
in corner lot and operate 24 hours it should be given 6 workers. Not more than
that. If it operates in middle plot, approve 3 people immediate once they
submit with tenancy agreement and license from local authorities. By this new
comer with new brand and foreign investor with new idea can open up restaurant
which eventually enrich our country. So there is no favors for big mamak
restaurant which so long depend on foreign workers to open up branches all over
nation. Be fair to all by system. Don’t give backdoor approval. By this way,
slowly restaurant operator can move to new level where less depends on foreign
workers. This how matured countries did early days.<o:p></o:p></div>

3) Barbers,
jewelers, textile workers approvals should not be given. Ask employer recruit
locals and don’t listen to their association plight. Most of the owners running
business 100% depend on foreign worker.

<li>Four category people not entitled in rehiring a)blacklisted worker b)workers who blocked by employers c) ppl who entered country illegally (by jalan tikus) d) student visa holder. Any other foreign worker can be registered in rehiring programe. Even a permit holder who intend to change employer also can be register. (this one i am not 100% sure but told by Immigration officer who incharge for this program to me) </li>
<li>Bukti Megah doing smooth job in rehiring program. Myeg catching up but their process taking time. </li>
<li>Cost still same around rm5000 each worker. register in myeg will cost 1200 then special pass will cost rm900 then levy will coct rm2050 then include medical rm200.</li>
<li>Dont give agent to do it cz almost all handle by the 3 appointed company and other agents cnt compete with this licenced crony agent.</li>

Next step myeg and consortium will follow up your process in immigration. Immmigration will issue sp to proceed to kdn for eligible workers and sp for sending back disqualify workers. This the steps involve in rehiring process as far as i understood.<br />

The workers who legalized in this rehiring programme only can work max 5year and most of them eligible for 3 years only.My advice is if your workers are Bangladeshi n working in allowed sectors and if you think your paper requirement can meet to 85% of kdn normal requirement, then you may apply. I dont recommend to source country workers since they can be legalized some sort of way if want with less cost and can get longer period of working years. this all only my opinion. the market requirement and situation in different for each sector and workers so u must decide is it worth to invest that much money on our workers.<br />

All employer who intend to legalise their Myanmar worker must go to this company which based in Johor but have sub branches all over states to register their worker. this company will help do legalisation process with fees. Before the levy high the fees is about rm5800 for each worker complete until sticker. I have seen this company representative doing the work in immigration daily. Employer may call the manager in charge(Bukti Megah) Regina 0166161491 for further information.<br />

For Indonesian they must go to Iman Resources to do legalisation. But i have little information how they conducting the process. Apart from this two companies other nationalities fate most probably would fall under MYeg and consortium. All of them minister level networked foreign worker agents. Their main propose is to make money by creating system in the name of helping government to legalize illegal. But i am sure the fees also will be around rm6k. Surprisingly other day minister mention about legalize in online without paying middle man which give some hope for thousand of workers who earning less than 1500 a month.<br />

Now government and cronies take advantage on vulnerable migrant workers to make money because they have less money in gov coffer to enjoy like previous years. Workers are the last victim cz almost all employer will touch the workers salary to cover legalization fees.<br />

From previous experience i want give some advice's for workers and employers who intend participate in rehiring process<br />

<li>Please wait and collect some information before start to go register because normally the fees will be high for few weeks until the market correct itself later part</li>
<li>Dont ever give full money to agent. please collect ic photocopy of agent if you want to give agent to run for you becaus there is so many cheating cases in previous legalization process.</li>
<li>For worker who intend to be independent than employer, find reliable employer which you personally know. If you dnt have one, consulate with good friend which have more experience hence been in malaysia for long</li>
<li>Make sure medically fit before start register</li>
<li>Start apply passport now in embassy if dont have one</li>
<li>check worker status in immigration in online under https://eservices.imi.gov.my/myimms/VPAStslng</li>
<li>Be aware if agent offer something other agents said impossible to do.</li>

According my source, this time it wont be like legalisation process as done in 2011. As we already know whole cake want to be eaten by crony company and that not going to be that easy. Myeg may loose the contract and dominance. Most probably rehiring process will be start whereby workers who entered country in work permit and overstayed will be given chance to be renew by paying minimum compaun.<br />

Illegals who have no document and entered country in social visa would have to leave country and can be rehire back. They will no blacklist or cooling period to rehire them back.<br />
Iman Resoucer will handle Indonesian and bukti megah will handle mynmar nationalities. this two company controlled by ministers crony. Other nationalities maybe process by myeg.<br />

However all this still in discussion and nobody sure how this time kdn going to do legalisation process.My advice is just wait for official announcement and take step after get clear picture. Free-zed service sector permit cant be renew if go straight to immigration or by Myeg as you all know. But it can be renewed if you go through influential agent. I mean by cable kuat agent who can get sign from minister. There is group doing this. however it will be costly since most of permit expired. There is another hope also in Jalan duta immigration. Please refer to credible agent there and i am not liable if you people loose money to any agent. I can understand your plight but what we can do when we vote for brainless people to manage country.<br />

2. Should i go to myeg or direct immigration to renew my workers permit<br />
<br />
If you have a lot of passports to renew, better you do it in immigration cz it cost effective for you. but if you have less than 30 workers, i suggest do it in myeg. There is speculation starting on may onward the rm38 service charge will be excluded. if you holding double paspport dont ever do in myeg .<br />

3. I have a worker in malaysia but his visit pass expired. can i employ him?<br />
By legally this cant be done unless you have strong cable to get Jp visa from KP(directr general). But almost all agent will promise that can be legalise. Yup there is loophole in immigration system to legalise them but it not that easy and depend on country of origin. if you want to do it please choose a reliable agent.<br />

4.is amnesty still on?<br />

Yup amenesty still ongoing..anyone who overstay and wish to go back can do by paying compaun rm400 in immigration enforcement department. no jail but will be blacklisted for 5 years. indonesian pls go to Imam resources in sri rampai cz there are special.<br />

No more jp visa for Indonesian maid if you go directly. You should use capable cable agent to do jp and definitely will cos you double. you have to go through licensed agent if you want to bring in maid from Indonesia in permit. No more direct hire .you have no choice than pay quoted amount by agent even the maid is yours.<br />

This high level monopoly of foreign worker industry started and playing by corrupted so called national leaders thinking that the employers in Malaysia have no balls.<br />

My suggestion is all employers should boycot Myeg and dont ever seek myeg service until immigration open their service counter. The service must be optional and not be compulsory. Immigration have no capability to arrest 2.2m registered foreign worker in this country if all employer decide to boycott.<br />

Starting this month and next 2 months immigration department all the state will be crowded by employer who busy renewing their workers work permit..mostly 6P cause this is the peak time 6P approvals came out last year. There is few issue i want share with readers and please take this as added information and don't ever trust 100% my information cz as you know the procedure/law will be changed anytime and only correct when the time i write<br />

*6P renewal for service sector other than cleaning service and restoran limited for 2 years only but you can apply appeal letter to kdn for extension. Putrajaya immigration just received the memo from kdn last week . I think this is not practical and soon will be open..i recommend employer to be patient and get update from immigration on this matter<br />

*People who overstay in Malaysia now have to face hard time cause enforcement department taking firm action. All the cases referred to DPP for action even if you voluntarily surrendered. Lot of people get caught in immigration itself for overstaying.<br />
